Who these terms are with

These terms are between you and My Backyard Sports, LLC, trading as Custom Pole Pads, of 570 Piermont Rd, Ste 125, Closter, NJ 07624.

Quotes and pricing

Prices shown on this website are starting prices for stock configurations and are indicative rather than binding. The price that governs your order is the one on the written quote we send you. Quotes are valid for the period stated on the quote itself. Where no period is stated, treat the quote as valid for 30 days.

Freight, installation and any applicable sales tax are quoted separately unless the quote says otherwise.

Orders and acceptance

An order is accepted when we confirm it in writing, or when we accept a purchase order issued against a current quote. We accept purchase orders from schools, districts, municipalities, universities and other institutional buyers, and can supply a W9 on request.

Custom production and artwork

Custom printed padding is manufactured to the artwork and dimensions you approve. Before production begins we send a proof showing placement and scale. Production starts only after you approve that proof in writing.

You confirm that you own or are licensed to use any logo, mascot, wordmark or other artwork you send us, and that our reproducing it on your order does not infringe anyone's rights.

Because custom items are made to your approved specification, they cannot be returned for a change of mind. Check the proof carefully. That is what it is for.

Measurements

Padding is built to the measurements you provide. There is no standard post size in this industry, so we will always ask you to confirm dimensions and, where possible, send a photograph. If a pad does not fit because the measurements supplied were incorrect, a remake is chargeable.

Lead times

Every quote carries a lead time. We give you a real one and we tell you if it comes under pressure. Lead times are good-faith estimates based on current production and freight conditions, and they are not guarantees against events outside our control.

Shipping and delivery

We ship to the 48 contiguous United States. Risk passes on delivery. Please inspect shipments on arrival and note any visible freight damage on the carrier paperwork before you sign, because a clean signature makes a damage claim very difficult to pursue.

Installation

Our own installation crews cover New Jersey, New York, Connecticut, eastern Pennsylvania and the Austin and Houston metros in Texas. Outside those markets we supply the product for installation by you or your contractor. Where installation is quoted, the quote assumes reasonable site access and a surface in sound condition.

Cancellation and returns

Stock items may be cancelled before they ship. Once a custom item has entered production it cannot be cancelled, because the materials have already been cut to your specification. Returns of stock items must be arranged with us first, must be unused and in original packaging, and may be subject to a restocking charge and return freight.

Warranty

Padding carries a 1-year limited warranty against defects in materials and workmanship. The full terms, including what is not covered, are on our warranty page. Products manufactured by third parties carry their own manufacturer warranties.

Limitation of liability

Our liability arising out of an order is limited to the amount you paid for the goods in question. We are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited.

Protective padding reduces the severity of impacts. It does not eliminate the risk of injury, and it is not a substitute for appropriate supervision, correct installation, or compliance with the rules of your governing body.

Governing law

These terms are governed by the laws of the State of New Jersey.
